Hey everyone, I’m considering renting out my property for less than a year. How do month-to-month leases work? Are they different from term leases in terms of LTB rules? Do I still need to use N12 for evictions? Would this be a good option for a short-term rental situation?

Month-to-month leases and fixed-term leases are pretty similar in Ontario. Here’s what you need to know:

  1. All leases automatically become month-to-month after the initial term ends.
  2. You still need to use proper notices (like N12) for evictions, regardless of lease type.
  3. Tenants always need to give 60 days’ notice to end a tenancy.
  4. The main difference is that with a fixed-term lease, you can’t end the tenancy before the term is up (except for at-fault evictions).

If you’re only looking to rent for less than a year, it’s risky. Once a tenant is in, they have the right to stay indefinitely unless you have a valid reason for eviction. You might want to consider other options like short-term rentals that aren’t covered by the RTA.

So ur saying even with a month-to-month, the LL cant just end it whenever they want?

That’s correct. In Ontario, landlords can’t end a tenancy just because they want to, even with a month-to-month lease. They need a valid reason as defined by the Residential Tenancies Act, such as personal use (N12) or demolition/extensive renovations (N13). The tenant’s rights are protected regardless of whether it’s a fixed-term or month-to-month lease.

wat about if the LL wants to sell? can they kick out the tenant then?
