Can I increase rent after moving back into my property?

Hey everyone, I’m planning to move back into my rental property next year. I’ll be living there for at least a year, but I’m wondering about what happens after that. If I decide to rent it out again, am I allowed to increase the rent? Or do I have to keep it at the same rate as before?

Actually, that’s not correct. If you properly end the tenancy using an N12 notice and live in the property for at least 12 months, you can relist it at any price you want afterwards. The key points are:

  1. Serve a valid N12 notice to your tenant
  2. Provide one month’s rent as compensation
  3. Actually move in and live there for at least a year
  4. After that, you can set a new rent price if you choose to rent it out again

Just make sure you’re doing this in good faith - the intention to move in must be genuine.

It’s not quite that simple. The landlord can’t just ‘kick you out’. There’s a process:

  1. The landlord must have a genuine intention to move in.
  2. They must provide proper notice (N12 form) and compensation.
  3. If the tenant doesn’t agree, the landlord must apply to the Landlord and Tenant Board for an eviction order.
  4. The landlord must actually live in the unit for at least 12 months.

If the landlord doesn’t follow these steps or it’s found they acted in bad faith, tenants can file a T5 application for compensation. The potential penalties for landlords who abuse this process can be significant.

Thanks for the clarification, everyone. I definitely plan to move in for personal reasons and will be there for at least a year. I’ll make sure to follow all the proper procedures with the N12 notice and compensation. It’s good to know I have options after living there for a year, but I’ll cross that bridge when I come to it.

The notice period for an N12 is actually 60 days, so that’s correct. Also, the termination date must be the last day of a rental period. For example, if rent is paid on the 1st of each month, the termination date should be the last day of a month.

Additionally, remember that serving the N12 doesn’t automatically end the tenancy. If the tenant doesn’t move out voluntarily, you’ll need to file an L2 application with the Landlord and Tenant Board to get an eviction order. This process can take several months, so plan accordingly.

Got it, thanks for the detailed info. I’ll definitely give at least 60 days notice and make sure the date aligns with the end of a rental period. I hope my tenant understands, but I’ll be prepared for the possibility of needing to go through the LTB if necessary.
